 OF THE HIGH QUALIFICATION COMMISSION OF JUDGES OF UKRAINE

Procedures of the judicial career

Selection for the position of a local court judge

The High Qualification Commission of Judges of Ukraine has completed the acceptance of applications and documents from candidates who are military personnel and intend to participate in the selection process for the position of a local court judge. A total of 306 persons submitted documents through the special procedure.

In total, 9,339 persons submitted documents for the selection and transfer procedures to local courts, including: 8,744 persons, intending to become judges, 595 judges, intending to be transferred to another local court.

Among these applicants are: 595 judges, 3,155 court officials, 2,137 prosecution officials, 1,032 attorneys, 354 military personnel, 2,066 other specialists.

The High Qualification Commission of Judges of Ukraine, sitting in Panels, has reviewed the materials of 9,338 persons applying for admission to the selection process for the position of a local court judge (qualification exam).

Based on the results of the sessions, the Commission decided to admit 7,860 persons to participation in the selection process (qualification exam):

  • to the exam in administrative court specialization – 2,908 judicial candidates;
  • to the exam in commercial court specialization – 2,456 judicial candidates;
  • to the exam in general court specialization – 7,373 judicial candidates.

868 candidates were denied admission to the selection.

Applications of 15 candidates were left without consideration.

The High Qualification Commission of Judges of Ukraine, sitting in Panels, also reviewed the materials of 595 persons, intending to be transferred to another local court.

Based on the results of the sessions, the Commission decided to admit 572 judges to the qualification exam:

  • to the exam in administrative court specialization  – 141 judges;
  • to the exam in commercial court specialization – 140 judges;
  • to the exam in general court specialization – 505 judges.

7 judges were denied admission to the qualification exam.

Applications of 16 judges for admission to the qualification exam were left without consideration.

Overall statistics as of 30.05.2025:

  • admitted: 8,432 persons;
  • denied: 875 persons;
  • applications left without consideration: 31.
  • By specialization:
  • 3,049 persons were admitted to the exam in administrative court specialization;
  • 2,596 persons were admitted to the exam in commercial court specialization;
  • 7,878 persons were admitted to the exam in general court specialization.

The official YouTube channel of the HQCJU broadcasted an online meeting of the Commission members Nadiia Kobetska and Roman Sabodash with candidates participating in the selection for the position of a local court judge and judges who intend to be transferred to another local court. They discussed procedural issues of the selection process, including the organization of the qualification exam.

In May, interviews were conducted with 44 candidates for the positions of appellate courts judges:

    1. administrative appellate courts:
  • number of interviews conducted – 30;
  • number of candidates who confirmed their ability to administer justice in the respective court – 6;
  • the issues of confirming the ability to administer justice in the relevant court, submitted to the Commission for consideration in plenary – 15;
  • number of candidates who did not confirm their ability to administer justice in the respective court – 9.
    1. commercial appellate courts:
  • number of interviews conducted –14;
  • number of candidates who have confirmed their ability to administer justice in the relevant court – 5;
  • the issues of confirming the ability to administer justice in the relevant court, submitted to the Commission for consideration in plenary – 3;
  • number of candidates who did not confirm their ability to administer justice in the respective court – 6;

The number of candidates in respect of whom the Public Integrity Council has processed materials is 53. Conclusions were provided in respect of 32 candidates, information – in respect of 18 candidates, conclusion and information – in respect of 1 candidate.

As of today, the High Qualification Commission of Judges of Ukraine has received 159 applications from candidates expressing their intention to apply for a judicial position in the appellate general courts included in the first group of courts in the first stage of the competition:

    • Zhytomyr Court of Appeal – 29 applications;
    • Zakarpattia Court of Appeal – 30 applications;
    • Zaporizhzhia Court of Appeal – 33 applications;
    • Sumy Court of Appeal – 27 applications;
    • Chernihiv Court of Appeal – 40 applications;

A special check has been launched against these candidates.

The official YouTube channel of the HQCJU broadcasted an online meeting of Commission member Serhii Chumak with candidates participating in the competition to the courts of appeal. The topic of the meeting was the specifics of the next stages of the competition.

Qualification evaluation for suitability of a judge for his/her position held and in connection with the imposition of a disciplinary sanction

Interviews were conducted with 5 judges:

  • 5 judges were found to be suitable for the positions held:  
    1. Hanna Hnatyk, Melitopolskyi City-Raion Court of Zaporizhzhia Oblast;
    2. Nataliia Zhdankina, Vinnytsia Circuit Administrative Court;
    3. Volodymyr Orlovskyi, Oleksandriiskyi City-Raion Court of Kirovohrad Oblast;
    4. Lesia Rybka, Bohorodchanskyi Raion Court of Ivano-Frankivsk Oblast;
    5. Pavlo Chyr, Borshchivskyi Raion Court of Ternopil Oblast;
  • The qualification evaluation of 2 judges has been terminated:
    1. Volodymyr Bezdidko, Prylutskyi City-Raion Court of Chernihiv Oblast;
    2. Volodymyr Halyn, Sambirskyi City-Raion Court of Lviv Oblast.

The number of judges in respect of whom the Public Integrity Council has processed materials is 3.

Conclusions regarding 2 judges were submitted:

1. Nataliia Dobrivska, Circuit Administrative Court of Kyiv City;

2. Liubov Kodrian, Apostolivskyy Raion Court of Dnipropetrovsk Oblast.

The Commission, in plenary composition and based on the consideration of the Public Integrity Council’s conclusions:

  • has recognized 2 judges as suitable for the positions held:

1. Hanna Hnatyk, Melitopolskyi City-Raion Court of Zaporizhzhia Oblast;

2. Pavlo Chyr, Borshchivskyi Raion Court of Ternopil Oblast.

 Secondments                                      

Eleven notifications from the State Judicial Administration of Ukraine on secondments were received.

The Commission considered the issues of secondments of judges:

  • To 11 courts due to excessive judicial workload or impossibility of administration of justice;
  • From 1 courts due to changes in the territorial jurisdiction of court cases.

The issue of early termination of judges’ secondments and their simultaneous secondments to 1 court was considered.

It was recommended that judges be seconded to the following courts:

  • Velykooleksandrivskyi Raion Court of Kherson Oblast (1 judge);
  • Oleksandrivskyi District Court of Zaporizhzhia  (1 judge);
  • Prymorskyi District Court of Odessa City (2 judges);
  • Kherson City Court in Kherson Oblast (1  judge);
  • Shevchenkivskyi District Court of Lviv City (2 judges).

Important decisions of the Commission

The qualification exam for candidates for the position of a local court judge and judges who have expressed their intention to be transferred to another local court has been scheduled, and the order of its stages has been determined. The HQCJU also determined the passing scores of the qualification exam stages.

The lists of basic test questions on general knowledge in the field of law and on each court specialization (administrative, commercial and general) have been published. Testing of general knowledge in the field of law and testing of knowledge in the specialization of the respective court will be conducted as part of a single test.

Methodological guidelines for evaluating practical assignments, performed during the qualification exam by candidates for the positions of local court judges and judges who intend to be transferred to another local court have been approved.

Participation in the events

May 06, 2025 – regular session of the Verkhovna Rada Committee on Ukraine’s Integration to the European Union.

May 07, 2025 – meeting with representatives of the Embassy of the United Kingdom of Great Britain and Northern Ireland in Ukraine.

May 07, 2025 – public presentation of the OECD Review Findings on Integrity and Anti-Corruption in Ukraine.

May 09, 2025 – Meeting chaired by First Deputy Minister of Economy of Ukraine, Oleksii Soboliev, to discuss proposed amendments to the Ukraine Plan, particularly step 3.2.

May 9–11, 2025 – participation in the meeting of the Working Group of the Council of Judges of Ukraine on the preparation of the Commentary to the Code of Judicial Ethics (Vinnytsia City).

May 12, 2025 – special session of the Verkhovna Rada Committee on Ukraine’s Integration to the European Union to discuss the implementation of the Ukraine Facility instrument.

May 13, 2025 – official reception at the Delegation of the European Union to Ukraine on the occasion of Europe Day.

May 14, 2025 – Conference “Ukraine on the Path to EU Accession: Enlargement Policy and the Role of the Rule of Law” held in Brussels, Kingdom of Belgium, at the invitation of the Members of the European Parliament.

May 20, 2025 – monthly meeting with representatives of the Directorate-General for Neighbourhood and Enlargement Negotiations (DG NEAR) of the European Commission to assess progress in implementing Sections 3 and 4 of Ukraine Plan, organized by the Ministry of Economy of Ukraine.

May 30, 2025 – International scientific and practical conference “Europeanization of Ukrainian Corporate Law” organized by the Supreme Court, the OSCE Support Programme for Ukraine, and the EU Project “Pravo-Justice”.

Litigation

The Commission’s interests were represented in 53 hearings of the Supreme Court.

Court decisions upholding the Commission’s position:

      1. Case No. 990/250/24 – claim filed by I.A. Kachur.
      2. Case No. 990/413/24 – claim filed by V.I. Olshanschenko.
      3. Case No. 990/135/24 – claim filed by L.V. Tsebryk.
      4. Case No. 990/106/25 – claim filed by A.Yu. Boichuk.

Additionally, by a ruling of the Administrative Cassation Court of the Supreme Court in case
No. 990/384/24, based on a claim by O.I. Shumeiko, the plaintiff’s application was granted, and the claim was left without consideration.

Moreover, in case No. 990/143/24, based on a claim by O.M. Pozniak, the Grand Chamber of the Supreme Court by a ruling dated 08.05.2025 dismissed O.M. Pozniak’s appeal, and upheld the decision of the Administrative Cassation Court of the Supreme Court dated 29.01.2025.

2701 inquiries and appeals were reviewed:

  • 16 lawyer’s requests;
  • 256 requests for information;
  • 112 appeals;
  • 2317 other inquiries.
